Nedbank says a former human resources executive it sacked almost five years ago over allegations of racial discrimination and fraud is challenging a recent Labor Court judgment upholding the company's actions against her.
Anele Makosazana Mpungose has faced allegations of misconduct ranging from describing black employees as lazy and incompetent to abusing employee benefits to buy BMWs at preferential rates. As a result, he was dismissed by Nedbank in May 2019. Ms Mpungosu challenged her dismissal at the Commission for Conciliation, Conciliation and Arbitration (CCMA), but Commissioner Michael Boyce ruled that her dismissal was substantially fair and ruled in an arbitral award dated 23 October 2020. However, the Labor Court rejected Ms Mpangose's application on February 19, saying Nedbank had established that her dismissal was fair and reasonable based on the evidence available. Nevertheless, Nedbank told News24 that Mpungose intends to challenge the court's decision.
