The East London Magistrates' Court has adjourned the hearing into the firearms shooting case against EFF leader Julius Malema and his bodyguard Adriaan Sniman until tomorrow to cross-examine defence ballistic expert JC de Klerk.
The pair are charged with unlawfully discharging a firearm in front of a crowd, thereby endangering the crowd at their fifth anniversary party at Sisa Dukashe Stadium in Mdantsane in 2018.
During his testimony, De Klerk made clear that ammunition presented by the state as evidence found at the stadium after the incident did not match the firearm allegedly used.
He testified that the province's ballistics expert, Mandisi Mgwadluka, who gave evidence linking ammunition found at the Sisa Dukashe stadium to the firearm allegedly fired by President Malema, had not adequately tested the ammunition and firearm.
He added that Mgwadleka had found only one shell casing found at the stadium that bore a trace that could have come from the weapon allegedly used by Malema.
He told the court that Mgwadreka did not analyse the cartridges thoroughly as required by his profession.
He also told the court that shell casings were found where the tent was pitched on the night of the incident, and suggested a number of possibilities, including that the shell casings may have been planted there, tampered with or moved to that location.
De Klerk is due to appear in court again tomorrow.
