A Gkebela man arrested on suspicion of raping prominent Gauteng businessman Andy Kawa more than a decade ago gave up his bid for bail in the city's magistrates' court on Monday.
The man, who cannot be named until he enters a plea, said during a brief court appearance that he no longer intended to apply for bail.
The state said it was willing to proceed with the lawsuit, but the case was delayed because the defendant needed to consult a doctor at St. Albans Correctional Facility about his leg injury.
The suspect was arrested two weeks ago. It comes 13 years after the incident along the Gkebela coast, where Kawa was allegedly thrown between sand dunes and gang-raped for 16 hours before managing to escape the next morning.
In a vicious attack in December 2010, her car was broken into and her belongings stolen.
The defendant was arrested while he was sleeping on a park bench in Summerstrand.

Police said the defendant, 48, was arrested in June 2020 in the Mount Road police area on suspicion of stealing goods, but the case was dropped and he was released four months later.
A DNA sample was taken at the time of his arrest, and just three years later, in June 2023, the results were found to be consistent with Kawa's rape case.
News24 previously reported that Mr Kawa was unimpressed with the latest developments in the case as he felt it was too late.
Mr Kawa is scheduled to appear in the Eastern Cape High Court in Gkebela next Monday in a civil case against the police.
She took Police Minister Bheki Cele and three officers from Humewood Police Station to court over the issue and sued the state for a whopping R5.8 million for alleged negligence in the incident.
She claims police did not do enough to properly investigate the matter.
