African National Congress (ANC) Secretary-General Fikile Mbalula accused the judge in the trademark case of focusing on politics rather than the facts regarding Umkhonto Wesizwe's ownership.
This comes after the High Court in Durban dismissed the ANC's appeal on the basis that the party did not contest the issue when MK party registration began.
The ANC has indicated that it plans to appeal the ruling.
Mbalula insists that the issue of trademarks and Umkhonto wesizwe goes beyond elections.
“We are discussing trademark issues, not politics. The judge is not a politician, he should stay out of politics, we should We gave him the facts and he should have dismissed us as saying you have no authority over this MK. These are not the same thing. We are not discussing MK versus ANC. He says MK is ours and this is a trademark, but he doesn't mention that in his judgment.”
ANC will appeal
The MK party says it feels vindicated by the ruling. Party leaders and supporters were in a jovial mood after a court ruled that the party could continue to use its name and logo.
MK supporters say the result will strengthen their voice and campaign for votes in the upcoming general election.
However, the KwaZulu-Natal ANC has said it will appeal the ruling. The party claims the incident was a matter of principle for them.
