The Gauteng High Court in Johannesburg has sentenced businessman Musa Ntsibande to 12 years in prison for the murder of his wife Hlengiwe Msimango.
In handing down the sentence, Judge Morebohene Mdalana-Maisela said the court had to deviate from the prescribed minimum sentence of 15 years due to Nchibande's personal circumstances.
She said: “[The] Courts must impose proportionate sentences to deter members of society. However, courts must distinguish between punishment and revenge. ”
On August 3, 2020, Nchibande shot his wife twice with a licensed firearm. In her defence, he claimed he thought she was an intruder at her home in Norkem Park, east of Johannesburg.
In September last year, he was found guilty of murder by final act (a defendant who objectively foresees that his or her act is likely to cause the death of another person, but takes action regardless of the consequences of that act). convicted.
