Iqbal Sabe's Sekunjaro Group was dealt another blow in its war with South African banks after the Constitutional Court rejected its appeal against a ruling that allowed it to close accounts with three South African banks, along with costs.
On Monday, the Supreme Court unanimously heard Mr Sekunjalo's challenge to a Competition Appeal Court (CAC) ruling that Standard Bank, Access Bank and Mercantile Bank had failed to establish a prima facie case that they had committed “prohibited conduct” under the Competition Act. Rejected by consensus. Act by closing accounts belonging to your company.
Mr Sabe had previously argued that the closure of Sekunjalo Group's bank accounts amounted to an abuse of dominance and/or collusion in violation of competition law, but the CAC was not convinced.
