The High Court in Pietermaritzburg has discontinued former president Jacob Zuma's private prosecution of lawyer Billy Downer and journalist Karin Maughan.
Mr Zuma accused Mr Downer, the lead prosecutor in the arms deal corruption case, and Mr Morgan of illegally leaking the doctor's letter to the media.
The matter was adjourned last year, with Mr Zuma appealing against two court orders obtained by Mr Downer and Mr Morgan seeking a stay of proceedings.
The first order declared the private prosecution null and void, and the second order granted an injunction to enforce the first order.
Mr Zuma lost appeals against the enforcement order in both the Supreme Court of Appeal and the Constitutional Court.
Justice Nkosinati Chili ruled that Mr Zuma's appeal is pending at the Constitutional Court against a court order that the private prosecution is invalid.
Mr Chiles ordered Mr Downer and Mr Morgan to reappear in court at a later date if Mr Zuma's appeal is successful.
“Mr Zuma’s private prosecution of Mr Downer and Mr Morgan has been removed from the register. Section 2: Such removal is without prejudice to Mr Zuma’s rights under section 11 of the Criminal Procedure Act 1977. ”
